The Division of Juvenile Services maintains a policy that states in part:
When receiving an allegation that a juvenile was sexually abused while confined at another facility, the head of the facility will notify the appropriate office of the agency when the sexual abuse is alleged to have occurred. The head of the facility will also notify the appropriate investigative agency. ( North Dakota Youth Correctional Center Policy 3C-4)

PREA requires “incidents” to be recorded in one of three categories: 1) Substantiated; 2) Unsubstantiated; or 3) Unfounded.
